These Terms of Service govern access to and use of Fennec Forms. By creating an account, accessing the service, or using a form, survey, quiz, embed, kiosk flow, or related feature powered by Fennec Forms, you agree to these terms.
The service
Fennec Forms is a hosted platform that helps people and organizations create forms, surveys, quizzes, and related response workflows, publish them, share them, embed them on other sites, and review or export submissions.
We may update, improve, add, remove, or change features over time.
Accounts and workspace responsibility
You are responsible for:
- providing accurate registration and billing information
- protecting access to your account and login credentials
- activity that happens under your account or workspace
- managing teammates, permissions, and workspace membership appropriately
If you create or manage a workspace for an organization, you represent that you have authority to act on that organization's behalf.
Creator responsibilities
If you use Fennec Forms to publish forms or collect responses, you are responsible for:
- making sure your forms and content comply with applicable law
- providing any notices, disclosures, or consents required for your use case
- making sure you have the right to collect, use, and share the information you request
- configuring your forms, response settings, and sharing methods in a lawful and appropriate way
- reviewing the data you collect and handling it in accordance with your own privacy commitments
Fennec Forms provides the platform, but creators decide what their forms ask for and why.
Respondent interactions
When a respondent submits information through a form powered by Fennec Forms, the creator or organization behind that form usually decides the purpose of that collection. Fennec Forms may host, transmit, store, score, display, and export submission data on the creator's behalf so the service can function.
Acceptable use
You may not use Fennec Forms to:
- violate law or third-party rights
- collect, transmit, or publish unlawful, deceptive, abusive, harassing, infringing, or harmful content
- send spam, phishing, malware, or harmful automation
- interfere with the service, other users, or platform security
- attempt unauthorized access to accounts, workspaces, infrastructure, or data
- misuse respondent data or collect sensitive information without an appropriate legal basis and notice
We may investigate suspected misuse and take protective action, including limiting features, removing content, suspending access, or terminating accounts.
Plans, billing, cancellations, downgrades, and refunds
Some Fennec Forms features are available only on paid plans. Paid subscriptions may include usage limits, feature restrictions, billing intervals, and owner-only billing permissions.
Billing for paid subscriptions is processed through Stripe or another payment provider we make available. By purchasing a paid plan, you authorize the applicable charges for the subscription you select.
Unless we expressly state otherwise in writing:
- upgrades may take effect immediately and may be prorated where supported by the billing provider
- monthly downgrades are generally scheduled for the end of the current billing period
- downgrades do not typically receive prorated refunds unless required by law
- annual plan downgrade, cancellation, or refund requests may require manual review
- only the workspace owner may manage billing for a paid workspace

Nothing in these terms limits any non-waivable consumer rights that apply under law.
Privacy
Our Privacy Policy explains how Fennec Forms handles account, billing, support, analytics, security, and submission-related data.
Availability, security, and service changes
We work to keep the service available and secure, but we do not promise uninterrupted or error-free operation. We may perform maintenance, release updates, change technical requirements, or limit functionality where reasonably necessary for security, stability, compliance, or product evolution.
Suspension and termination
We may suspend, restrict, or terminate access to the service if:
- fees remain unpaid
- we reasonably suspect abuse, fraud, spam, malware, or security risk
- you materially violate these terms
- continued access creates risk for Fennec Forms, our users, or the public
You may stop using the service at any time. Termination or cancellation does not eliminate obligations that arose before the account or subscription ended.
Intellectual property and feedback
Fennec Forms and its related software, branding, and platform materials remain the property of Fennec Forms or its licensors. These terms do not transfer ownership of the service to you.
If you send us product suggestions, ideas, or feedback, you agree that we may use them without restriction or compensation.
Disclaimer
To the extent permitted by law, the service is provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free.
Limitation of liability
To the extent permitted by law, Fennec Forms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, business opportunities, goodwill, or data, arising out of or related to the use of the service.
To the extent permitted by law, our total liability for claims arising out of or related to the service will not exceed the amount you paid to Fennec Forms for the applicable paid subscription during the 12 months before the event giving rise to the claim.
Changes to these terms
We may update these Terms of Service from time to time. When we do, we may revise the published effective date and post the updated version on this page.
